Trust Deed Advert

Section 169
FORM 1
NOTICE IN THE REGISTER OF INSOLVENCIES BY TRUSTEE UNDER A TRUST DEED FOR THE BENEFIT OF CREDITORS.
The Bankruptcy (Scotland) Act 2016

Kevin George Park

10-Feb-1992

A Trust Deed has been granted by Kevin George Park of 23 FORREST ROAD, PETERHEAD, ABERDEENSHIRE, AB42 2XP, (and formerly of 1 ACACIA GROVE, PETERHEAD, ABERDEENSHIRE, AB42 2WT) on 23-Nov-2023 conveying [(to the extent specified in section 167(1) of the Bankruptcy (Scotland) Act 2016,)] his/her whole estate to me Nick Payne, of Payplan Scotland, Kempton House Kempton Way, Dysart Road, GRANTHAM, Lincolnshire, NG31 7LE as Trustee for the benefit of his/her creditors generally.

If a Creditor wishes to object to the Trust Deed for the purposes of preventing it becoming a Protected Trust Deed (see notes below on the objections required for that purpose) notification of such objection must be delivered in writing to the trustee within 5 weeks of the publication of this notice in the register of insolvencies.

Notes: The Trust Deed may become a Protected Trust Deed unless within the 5 weeks of the date of publication of this notice in the register of insolvencies a majority in number, or not less than one third in value, of the Creditors, notify the Trustee, in writing or through electronic communication, that they object to the Trust Deed and do not wish to accede to them.

Briefly, this has the effect of restricting the rights of non-acceding Creditors to do diligence (i.e. to enforce court decrees for unpaid debts) against the debtor and confers certain criteria upon the trust deed from being superseded by the sequestration of the Debtor’s estate.
