The Register of Insolvencies (the Register) is an online public register which holds information on the insolvency of individuals and businesses in Scotland and individuals granted a moratorium.
The Accountant in Bankruptcy (AiB) is required by statute to maintain the Register and make it available for public inspection.
AiB’s Privacy Notice, which can be read here, explains how the Agency collects, stores, uses and shares personal information, how it protects people’s privacy and who to contact if you have any concerns.
The information in this Register is removed in accordance with AiB’s Retention and Destruction policy, which can be read here.
AiB seeks to ensure the information published in the Register is up-to-date and accurate.
While every effort is been made to ensure that the information provided is accurate, occasionally errors may occur, AiB cannot accept responsibility for any errors or omissions as a result of negligence or otherwise.
The information in this Register does not constitute legal or professional advice and AiB cannot accept any liability for actions arising from its use.
AiB shall not be liable in contract, delict or otherwise for any loss of business, contracts, profits or anticipated savings or for any indirect or consequential loss whatsoever.
AiB shall not be responsible for searchers’ use of the information held in the Register and does not endorse, nor make any representations regarding, any use made of the information in the Register by third parties. Without limitation to the generality of the foregoing, the searcher shall be responsible for complying with any applicable data protection, copyright and other legislation and regulations.
In no circumstances shall AiB be liable to the searcher for any loss or damage arising from any interruption or cessation of the online Register facility.
AiB will endeavour to ensure that the Register is available for access at all times, excluding periods of planned maintenance and data processing. A notice will be posted on the AiB website, www.aib.gov.uk, to advise searchers of impending maintenance. Where the Register is not available for any other reason searchers should notify AiB. In the event that the register is off-line for at least two full working days following the fault notification AiB may offer, where practicable to do so, a discretionary facility to conduct urgent searches.
Where AiB is affected by Force Majeure, searchers will be notified promptly of the nature and extent of the circumstances in question. AiB shall not be deemed to be in breach of obligations in relation to maintenance of the Register to the extent that any delay or non-performance is due to any Force Majeure of which searchers have been notified. The time for performance of any obligation shall be extended by such reasonable period as shall be agreed between AiB and searchers.
The Register must not be used in any way that causes, or may cause, damage to the Register or impairment of the availability or accessibility of the Register; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.
